The Current Pretrial Detention Of Ayaba Cho Will End On Nov. 19, But Prosecution Can Ask For Another Extension

 The US based Nsahlai Law Firm, has done a comprehensive translation into English and French, of the official Court Hearing Report from the Oslo District Court, concerning the case of Cho Lucas Yabah  

.The case against the leader of the Ambazonia Defence Forces, ADF /AGoVC, AYABA CHO LUCAS, who is on pretrial detention in Norway on charges of INCITEMENT TO CRIME AGINST HUMANITY, last came up at the Oslo District Court in Norway on October 22, 2024. The case, No: 24 – 163050 ENE – TOSL / 07 on October 22, 2024 concerned a request by the Prosecution for the extension of Ayaba’s pretrial detention for another four weeks.

It would be recalled that the ADF / AGoVC leader, Ayaba Cho Lucas, was arrested at his residence in Oslo, Norway on September 25, 2024 and taken to the Oslo District Court, where the charge of Incitement to Crimes Against Humanity was leveled against him. The court ruled that he be placed on pretrial detention until October 23, 2024.  On October 22 at the Oslo District Court, the Prosecution requested for the extension of the pretrial detention by another four weeks.

Translation Of Court Document By Nsahlai Law Firm

It should be noted that the case against the detained ADF/AGoVC leader, Ayaba Cho Lucas, at the Oslo District Court, is holding in the Norwegian language.  In a bid to enable Cameroonians to better understand what is going on in the court, the US based Nsahlai Law Firm of Barrister EMMANUEL NSAHLAI, has taken the pains to meticulously do a comprehensive translation into English and French, of the official court record from the Oslo District Court concerning the case of CHO LUCAS YABAH, as the Ayaba Cho Lucas is known in Norway.  The Nsahlai Law First has noted that the translated document “encompasses the official court hearing report dated October 22, 2024 from the Oslo District Court concerning Cho Lucas Yabah, charged with incitement to crimes against humanity”.

The Nsahlai Law Firm has on its Facebook published alongside the translated versions, the original version of the document in the Norwegian official language. It is thanks to the work done by the Nsahlai Law Firm in the translation of the document into English and French, that The Mentor News has been able to exploit the Court Hearing Report of October 22, 2024.

Lawyer Of Victims Of Atrocities Committed Against Civilians

Worthy of note that the US based Cameroonian born human rights lawyer, Barrister Emmanuel Nsahlai, is  the legal  counsel or lawyer of several victims of atrocities committed by separatist  groups including ADF, in the Northwest and Southwest Regions of Cameroon, in the ongoing Anglophone Crisis. It should as well be noted that it was a report that Barrister Nsahlai filed with the judiciary in Norway, as well as a complaint he wrote to the Prime Minister of Norway, against Ayaba Cho, for the horrible atrocities being committed against the civilian population in the Northwest and Southwest Regions of Cameroon by the ADF, constituted the major push that made the Norwegian judiciary to open up investigation against him.  Barrister Nsahlai is known for his relentless efforts in fighting for victims of the Anglophone Crisis in Cameroon, especially civilian victims of the atrocities committed by separatist fighters.

Court Grants Request For Extension Of Pretrial Detention

Meanwhile the Oslo District Court in the session of October 22, 2024, granted the request that was made by the Prosecution, for the extension of the pretrial detention of Ayaba Cho Lucas, for four weeks. The Prosecution had argued that there was a risk of evidence tampering if Ayaba Cho was released on bail, as the investigation concerning his matter is still going on. The Prosecution demanded for the extension of the pretrial detention of Ayaba Cho for another four weeks, which the court granted.

It is stated in the Court Hearing Report of October 22, 2024, that: “The court believes that there exists a risk of evidence tampering. The court has considered alternatives to detention. The court believes there are no alternatives detentions that sufficiently reduce the risk of evidence tampering. The Prosecution has requested for four weeks. The court finds this sufficiently justified and that it does not constitute a disproportionate intrusion. The detention for up to 4 weeks is granted”.

Restriction on Mails And Visits

The Prosecution also asked for restriction to be placed on Ayaba’s mail and visitations, saying there was risk of evidence tampering, if Ayaba was permitted to have access to his mails and to receive visitors. The Court Hearing Report stated that: “The Prosecution has also requested a ruling for a mail and visitation ban for 4 weeks. The court believes the investigation will be compromised if the accused does not have restrictions on mail and visitation, referencing the assessments of the risk of evidence tampering. It is crucial for the investigation that the accused does not have the opportunity to communicate messages or share information from the case with others during what remains an initial phase of the investigation. The police have arranged for Yabah to meet his immediate family”.

 Possible Extension Of Pretrial Detention

Meanwhile court document shows that the current four week extension of the pretrial detention of Ayaba Cho will not go beyond November 19.  However the Court Hearing Report of October 22, 2024, also shows that there is a possibility of extending the pretrial detention of Ayaba beyond November 19, if the Prosecution makes another request.  The court report discloses that: “The Prosecution has not specified how long they intend to keep Yabah detained. The court assumes in its assessment that the detention may be requested to be extended for a long time”.
